A reminder to all:
We do not allow the selling of illegal goods in the Classifieds forums. Pirated video and audio are illegal in the Philippines.
The first attempt to sell such items will get you a WARNING. The second attempt will get you BANNED.
Counting starts today.

New procedure for threads selling pirated video/audio:
1) The thread will be CLOSED, not DELETED when I first see it.
2) Ada will check the thread and warn the thread starter.
3) When the warning is sent, the thread will be deleted.

Placing a pirated video/audio/software ad thread in a forum outside Classifieds can also get you banned. Other moderators are also watching.

What if the seller did not say that the goods are pirated, then you guys have no way to tell which ones are pirated are not?
BTW does selling of xxx-rated VCDs and DVCs allowed?

1) From our experience, nobody selling pirated video or audio on PEx has actually said that their goods were pirated. We don't think anybody will be honest enough to do that in the future. Without checking the merchandise individually, we cannot be sure which ones are pirated or not. We are not going to check. But we are going to use our judgment to evaluate such other factors as the price of the merchandise, whether original releases of the merchandise are actually available in the market, and the reports of other PExers, to form an opinion on whether the goods are pirated or not. If we suspect that the goods are pirated, the seller will be warned and/or banned.
If anyone insists on buying or selling pirated material, we cannot stop him. But please do not use PEx to help you.
2) Pornography is illegal in the Philippines, but the definition of pornography is too vague to make implementation of anti-pornography laws effective. If the government bans specific titles by name, we will ban them, too. Otherwise, we will rule on "pornography" on a case-to-case basis. In the meantime, you are not allowed to sell pirated "pornography", or display images on PEx of a "pornographic" nature, or hyperlink to websites which sell pirated "pornography" or which display images of a "pornographic" nature.

then the selling of anything without proper DEALERSHIP ought to be deemed illegal too, if we are going to adhere to laws. Thus, someone cant sell something without authorization from the sales office of that brand.

Hey Kuya Danny...
I have my fault on my thread at the classifieds area..
i put it there under VCD`s Original and Pirated..
Just fyi im an owner of a Video shop and my intentions is to sell some of my properties
and also i have no intentions for
not abiding the rules here..
so, im requesting for a deletion of that thread.. Thanks a lot!

Question: If I record something on TV, burn it on CDR and sell it is that piracy? Let's say I recorded "Game ka na ba" TV show with USA Pres. Bush as the contestant and burned then sell it as VCD. How can you consider that piracy? Please enlighten me.

It is piracy. You may record anything from TV for the purpose of watching it later in the privacy of your own home. If you sell your recording without paying royalty to the owner of the show you recorded, it is piracy.

and i'm from the home entertainment industry and i'm always watching the threads... trust me, i know when it's pirated...
if you got any quessis regarding pirated products and it's technicalities, feel free to ask me...

If you make a compilation from originals you own, and sold the compilation to another person, you must first ask permission from the owners of the songs. If you do not have this permission, you have just committed an act of piracy.

What about those people selling cellphone applications, the ones that are generated with cd keys or cracks... will they get a ban??? If its piracy, the government i think hasn't done something about it... Karamihan kasi ng nagbebenta ng pirata dito sa pex use cds & tapes, eh pano yung gumagamit ng bluetooth/infrared/card readers to sell their thing? Basta walang liscence ng software considered piracy na yun?

I just want to reiterate that we have an anti-piracy policy here in PEx which we strictly enforce. The following are not allowed:
1. Selling of pirated CDs, DVDs, and VCDs.
2. Looking for pirated CDs, DVDs, and VCDs. If you are looking for a certain TV show series or an album, make sure you that specify that you are looking for an original copy. Otherwise your thread will be removed and you will be sent a warning.
3. Selling of e-books [unless you can prove that the book's copyright has expired and is free for distribution, e.g. Noli Me Tangere.]

If you're not the author, artist, writer, or creator of the said medium intended for mass distribution without the consent of the publisher and/or creator - that's piracy. No matter how many times it's turned upside-down, slapped with a million layers of golden paint, decorated with flowers and all... ...but without a single approval or authorization of said publisher and creator is considered piracy. It's as simple as that. :naughty2:

The Rights and Wrongs of Music Piracy

I like music. I love discovering new bands. I enjoy the sound and the fun and the thrill. I especially love the digital music. I used to listen to cassettes in my Walkman; now I carry my entire music collection in something the size of one of those old tapes.
But with all that fancy new technology comes a problem: It’s really easy to break the law. Technology has made it simple to make a copy of a friend’s CD or find an illegal song online. But no matter how easy it is; it’s still illegal.
That should be the end of the story, but somehow it’s not. Somehow music piracy continues, even among Christians. In fact, surveys tell us Christians steal music as much as everyone else.
Let’s look at the rights and wrongs of music piracy.
Top 10 Reasons to Steal Music:
10) You didn’t know.
Unauthorized duplication or distribution of music is illegal. That includes mixed CDs for your friends and illegal downloads on P2P networks. (Note: It’s apparently fine to burn copies of any music you legitimately own for your own use. Your “own use” does not include “trading with friends.”) Now you know, and knowing is half the battle.
9) You’re a thief.
Let’s face it: it’s illegal. No way around that. You could face a maximum sentence of 5 years in prison. Won’t mom be proud?
8) You want to be a pirate, arr!
Nice try. But as suave as Captain Jack Sparrow may have seemed in Pirates of the Caribbean, he’s still a criminal. Piracy doesn’t end well in the real world.
7) You’re lazy.
It’s easy to steal music nowadays, so why not? Maybe because ease of use doesn’t make it OK. It’s also easy to jump off a cliff, but most teens aren’t lining up for that one.
6) You’re broke.
Aren’t we all? Stealing a necessity like a loaf of bread might be debatable, but Justin Timberlake you can live without.
5) You’re cheap.
Aren’t we all? But do the math. Legally buying a CD: $15. Pirating a CD: $3,000 average fine.
4) Musicians are rich.
And that makes stealing OK? The truth is not all musicians roll in pimped out SUVs. Many roll in rust buckets, and selling CDs is how they pay the bills.
3) Record companies are ripping us off.
And that makes stealing OK? Maybe record companies are charging outlandish prices for music, but the law is still the law. Boycott their music completely if it upsets you that much. But in reality, CDs are getting cheaper. Plus, you can buy single tracks online for under a buck.
2) It doesn’t hurt anyone.
It’s easy to make that argument with digital files. They’re not physical objects like T-shirts or stereos. But they still cost money to produce. By ripping them off, record companies and artists make less money. So they raise prices, drop artists, and make fewer CDs, meaning less music for you and your friends. Now who’s hurting?
1) You won’t get caught.
The police may not bust down your door for the lone CD you ripped, but someone knows. He knows if you’ve been bad or good, and I’m not talking about Santa. There’s no hiding music piracy from God.
Top 10 Reasons NOT to Steal Music:
10) Saving face.
Nothing’s more embarrassing than having your favorite artist sign your burned copy of their CD. Ouch.
9) To support musicians.
Only a handful of artists rake in the cash. The rest struggle to make ends meet, often working second jobs and playing on the weekends. Paying for their music helps pay their bills, and that means the music can keep coming.
8) A clean conscience.
Why burn CDs or download illegal files and break the law, risking stiff fines or imprisonment? If you don’t steal music there’s no worries, no guilt. Who ever thought doing the right thing could be so easy?
7) You don’t have to.
Why steal music when you can listen to tracks online at sites like myspace.com and purevolume.com. Many artists and bands let you download a free song or two from their latest album.
6) The radio.
That old, antiquated concept of radio still delivers free music. Many stations are switching to newer formats with fewer commercials and better variety. There are also online radio stations and podcasts that can fill your music fix.
5) Online music stores.
iTunes and other online music shops make it easy and legal to download music. You can buy the few tracks you love for cheaper than the CD, and some sites let you pay a flat monthly fee for all the music you can handle.
4) You can borrow it.
Swapping and ripping CDs from friends may be the (illegal) norm, but why not just borrow the CD? Listen to it for a while, and return it when you’re done. No harm, no foul.
3) Be different.
Just because everyone else is doing it doesn’t make it right. Be a trendsetter, and do what’s right.
2) Consistency.
You tell people you love Jesus, and you don’t steal music. Your faith and your actions line up. Even people who don’t share your conviction will notice you live by what you believe.
1) Integrity.
Not many people have integrity today, but you can. It’s not very expensive, and it’s more valuable than any download.
