View Full Version : Training bond:HELP!!!!

Hi! I am newbie but am really glad I found this site. I need counsel as what to do with my current situation. I used to work for a call center. I signed a pre-employment contract stating a training bond that I will need to reimburse if I do not meet the expected training completion of 6 months. I had to leave the company after 3 months due to a family emergency and thatw as in April. Yesterday, received a letter fom them demanding I pay the bond IMMEDIATELY. What should I do? SHould I be even alarmed or should I just ignore them? I mean, It's already been 8 months and now they're going after me. A friend told me that training bonds are actually illegal accrdg to our Labor Code. Is it true??
Please! I need advise ASAP!! I really do not know if I should be alarmed about this. HEEEEEELLLLLPPPPP!!!! PPPPLLLLEEEEAAASSSEE??? :depressed:

Just avoid them let them come to you. How much is the bonds ba?? If its less than P200,000 I say ignore them their legal costs pursuing you is not worth their time anymore.

Hi!!

Thanks so much for the quick reply. The bond is P25,000 (after deductions) , originally P50,000. In the latter part of the letter they sent me, they said that if I do not pay in the next 5 days, they will contact their lawyers and all charges incurred will be billed to me. I am not scared, more curious actually.

I worked abroad for the past 5 years and am not really familiar with our labor code so I do not have an idea how to go around this one. I do not have an idea if they really have a hold on me.

What if they send me another letter? Or keep on harrassing me? Is there anyway I can keep them from doing that? In a way, I feel that I had been given NO choice at all when I signed the contract. It's either sign and acknowledge the bond or don't sign and I don't get the job.

This is really frustrating for me. Thank you so much for replying. I'd welcome any more thought from you.

Just ignore them. Actually the training bond wala talaga yung sa Labor code natin. and i have a friend na same problem with you pero he just ignore it, he also receive a letter na they will contact lawyers and the charged will be billed on him. but wala naman. I think nananakot lang yan. :) Don't be scared kze if they will do that malaking money din and time ang mawawala sa kanila db.

ignore lang...ako nga nabigyan na ng subphoena before wala rin nangyari kasi sobra dami din namang umaalis eh

alam ko *** a, *** naman nakukulong sa utang..kaya kahit nde mo bayaran ok ***, panakot *** yung mga lawyers n yun..

is there a section in the labor code that prohibits training bond? ako more than Php200k ang training bond ko and i want to be out of this company after 2 years. sorry kung OT pero kung meron lang nakakaalam to enlighten me.

don't worry bout it too much. friend ko nagresign din and she is obliged to pay 25k for the bond, hinde na niya binayaran naguwi pa siya ng headset :lol: clearance ata nahold sa kanya and the company did not paid her SSS and Tax.

bad... :( hindi na nga nagbayad, kumuha pa ng company property. d biro ang price ng headset ah..jan pwedeng makasuhan ang friend mo kc theft un. *okay*

nways, ang hassle lang ng training bond siguro is that mejo mahihirapan kang pumasok sa ibang call centers, lalo na kapag reputable *** company, since they invest in background investigations.

Makes on wonder if it's worth investing in Filipinos. Spend money on training them, then they run off without a return on investment.

BTW, despite there being no mention of a training bond in the labor code, you can be sued under the Civil Code laws on obligations and contracts. If they can't get you on one law, they can get you on others. And don't blame your ex-employers if they float your name to the rest of the industry and keep you from being hired.

training bonds actually "ensure" (quotations intended) that trainees will stay in the company for a specific period of time in return for the training that they have received.

Ikaw ba naman, mag train ng tao tapos iiwan ka lang without rendering due service, e paano pa mag susurvive ang company mo kung lagi na lang aalis ang mga employees mo because nothing is stopping them?

Kaya it's a usual clause sa contract. So pwede ka ngang habulin if you decided to leave without "paying" the bond because it will be considered a breach of contract.

Marami na ngang hindi na hinabol... hindi dahil sa hassle sa company, but rather dahil sa mabagal na judicial system dito sa pinas. So ano ang pwede nilang gawin?

1. hold your clearance
2. advertise to all companies who are doing background checks that you have not been "officially" cleared
3. file a lawsuit and when you are issued a subpeona, this makes it hard for you to get an NBI clearance as well as a VISA.

Alam nyo - sana alam nyo yang pinagsasabi nyo - MALASAKIT IS ONE THING AND SLANDER IS ANOTHER THING. It's so unethical and cheap by the way. I can't believe this thread is still open.

Slander for spreading word that a person jumped his bond? That's merely stating the truth: that the guy left without fulfilling an obligation, caveat emptor. You'll do the same when you buy dimsum and find rat meat.
