nagtataka *** ako, kasi 6 months pa lang ako dito sa call center na ito, sabi samin taxable daw ang 13th month namin....bakit kaya? tinanong ko mga kasama ko na matagal na dun...di naman daw ganun last year....labo...

sa lahat nang pinagtrabahuhan ko ngayong lang ako nakarining ng taxable 13th month...tsk...tsk..

Naloko kayo ng Employer nyo. Walang tax ang 13 month pay...

Where you previously given untaxed bonuses that reached beyond PHP30k for this year? I asked this because this would compel your employer to tax your 13th. Month Pay.

As per the National Internal Revenue Code, bonuses - including the mandatory 13th. Month Pay - are exempted from taxation up to PHP30k per year.

Pinoynetwit ask ko lang ilan days lang ba ang allowed ng labor code for the employer to process an ex-employee's last pay from the day of clearance? allowed ba ang 60 days?

Also, kelan entitled ang isang empleyado for tax refund?

Hi All,

Yes 13 month is purely taxable, but not fully- It depends on company to company .
Normally 13 month is added in the company balance sheet as cost center cost passed benefits----- in simple terms--- company/callcenter showing the govt that this is the money we will pass to the people working for company

Now to get the tax rebate and permanent tax solution,this is taxable on each individual salary .


Normally 13 month pay is calculated on the following formula
no of months worked in company/12 * basic pay of person


Most important if ur base pay is above 75k then it might be the case that ur will taxable on 50% of ur base pay while calculating the 13 month pay

yun lang...kasi 6 months pa lang ako dito so pagdating ng 13th month pay ko mga kalahati lang ng basic ko w/c is 20k divided 2, so far wala pa naman akong nakukuhang untaxed bonus ** samin...puro problema lang...

sa previous call center ko naman mga 2-3 na ako ni isang beses di ni-tax 13th month ko

sir jobsmanila, ganun ba yun? kasi during the previous years di naman daw taxable 13th month nila tapos this year meron na...what could merit the change kaya?

di ko sasabihin muna anong call center to...secret muna :)

I remember seeing 45 days in the Labor Code as the deadline for processing backpay. I strongly suggest that you sift through the labor code in http://www.chanrobles.com/legal4.htm website to make sure...in case you need to use it against an erring employer.

The tax refund should be credited by January 25 of the following year. Again, the NIRC is explicit on this:

(H) Year-end Adjustment. - On or before the end of the calendar year but prior to the payment of the compensation for the last payroll period, the employer shall determine the tax due from each employee on taxable compensation income for the entire taxable year in accordance with Section 24(A). The difference between the tax due from the employee for the entire year and the sum of taxes withheld from January to November shall either be withheld from his salary in December of the current calendar year or refunded to the employee not later than January 25 of the succeeding year.

13th. Month pay 101 as per Chapter 6 gross Income, Section 32 of the NIRC :

(B)? Exclusions from Gross Income. - The following items shall not be included in gross income and shall be exempt from taxation under this title:

(e)? 13th Month Pay and Other Benefits. - Gross benefits received by officials and employees of public and private entities: Provided, however, That the total exclusion under this subparagraph shall not exceed Thirty thousand pesos (P30,000) which shall cover:
?
(i)? Benefits received by officials and employees of the national and local government pursuant to Republic Act No. 6686;
(ii)? Benefits received by employees pursuant to Presidential Decree No. 851, as amended by Memorandum Order No. 28, dated August 13, 1986;
(iii)? Benefits received by officials and employees not covered by Presidential decree No. 851, as amended by Memorandum Order No. 28, dated August 13, 1986; and
(iv)? Other benefits such as productivity incentives and Christmas bonus: Provided, further, That the ceiling of Thirty thousand pesos (P30,000) may be increased through rules and regulations issued by the Secretary of Finance, upon recommendation of the Commissioner, after considering among others, the effect on the same of the inflation rate at the end of the taxable year.

THE LAW IS QUITE EXPLICIT ON GIVING A PHP30K ANNUAL TAX EXEMPTION LIMIT FOR ALL KINDS OF BONUSES RECEIVED...AND THAT EXPLICITLY INCLUDES THE 13TH. MONTH PAY. This is a no-brainer issue. Even without consulting anyone here you could get explicit answers from the BIR website and know your rights.


Be that as it may, I have heard a lot of incidences of violations of the provisions I stated here.

not a fact. if you never experienced getting more than 30k a month, average per in a year... then youll never get taxed. i think this is the reason why most would assume is totally non taxable. i worked for BIR

yah, taxable ang 13th mo if your ave monthly salary is more than 30k. as for me, never pa naging taxable ang 13th mo ko, hehe.

isa pa, you can get your 13th for as long as you worked 30 days sa isang company (so your 1 mo salary over 12 months...that will be your 13th mo). i remember, meron kaming kinasuhang company dahil sa ganitong lokohan. haha
