Hi I'm a trainee for a call center company for the past month, However something just came up in my school and I really need to leave the job but because I have not finished my 4 month probation period I may to pay 20k to compensate the company. Is there anyway I can go around this?HePlease help mel call center veterans

Sure ba yan na hindi sila maghahabol? I've no plans naman to return eh. Paano ka ba nila hahabulin para sa compensation nila?

They wont go after you pare. They wouldnt spend a single cent doing that, unless you did a crime to the company. But ther than that, they won't go after you.

what does it say on your contract? abt not being able to finish your 4 month probation period. magbabayad ka ba talaga you may wanna consult a lawyer.

Next time read your contract before you sign it!

Kaya nga sila naglagay ng bond kasi alam nila na magiinvest sila sayo tapos bigla mo sila lalayasan...

Iniinform naman during contract signing na if u leave them w/in 6 months or 1 year eh magbabayad ka ng specified amount. Umagree ka dun tapos lalayasan mo after...

Diba uso sa mga college students ngayon na magwork sa call center for two to three months during summer tapos pagdatig na ng june sisibat na sila? Saka hindi ko naman ineexpect na I would be transfered to a different school eh.

Ang ginintuang aral sa pag-apply sa call center:

"Basahin mo muna ang kontrata hanggang sa kahulihulihang tuldok bago mo ito pirmahan"

Eto ang maganda mong gawin, lapitan mo ang iyong bisor at sabihin mo sa kanya ng mahusay ang iyong dahilan ng pag-bibitiw mo sa trabaho. Sa mga ganyang kaso ng pag-bibitiw bunga ng mga bagay na may kinalaman sa eskwela, maaring i-waive ng Human Resources ang employment bond. Good luck na lang kung may pagkapusong-bakal ang HR pagdating sa employment bond.

hindi totoo yang mga bond na yan...its a case to case basis.....ako nga dati sa vxi 15k ang bond ko pero di ako nag awol...nag resign lang pero may nakuha pa akong 10k after ko umalis...akala ko nga dun lang mapupunta sa bond ko yung 10k...buti di naman....pero sa pag kakaalam ko pag dito ka lang nag training....di ka naman hahabulin kasi ang daming applicants kaya hindi mag aaksaya ng pera
ang isang call center para sa attorney's fee kung isang agent lang ang nag awol...mag awol ka na lang ...hahahaahahaa

pero ibang usapan pag sa abroad ka nag training....ang alam ko accenture nag hahabol talaga kung sa abroad ka nag train....yung kapitbahay namin software engineer pinadala sa states and alam ko may bond siya....

syempre .....commonsense na lang bakit kailangan may bond ka.....at
kailangan mong magbayad kung di mo natapos ang contract mo....syempre pinadala ka sa states...free board and accomodation
tapos lalayasan mo lang pag may nakita kang mataas na offer..lugi talaga ang company dun so kailangan na habulin ka pag di mo natapos yung contract ng bond mo....

pero kung dito ka lang nag train...wag ka matakot! marami ng nag awol na gaya mo at wala pang nakukulong...hahaaaa...yun nga lang
wala ka ng back pay kaya pag nag awol ka siguraduhin mong ilang araw lang ang napapasok mo para di ka manghinayang sa back pay....

hahaaaa..naalala ko tuloy yung first call center job ko.....tanggap na ako sa vxi pero ang tagal pa ng umpisa.....mga 3 weeks pa ang antay ko....so ang ginawa ko apply muna ako sa iba na mga start agad...fortunately..natanggap ako sa telecenter...yung call center sa sm manila....one week lang ako dun...masaya naman kasi one week lang may pera na ako...2,500 yata...buti na lang binigay agad..kasi wala ng cut off pa pumasok ako from monday to friday
then friday ng hapon binigay na ng cash yung 2500...ang saya saya kasi monday ng start na ako sa vxi may pera pa akong 2500 hahaha..
di na ako pumasok sa telecenter...

Just to be on the safe side you may want a lawyer to review the bond..

Bonds are tricky, some are full-proof, we encountered a problem w/ one of our reps because of a bond issue from a previous center..

And yes there are centers who pursue the bond:

The sample case: the rep flew to Hong Kong c/o the BPO company for a NASDAQ License.. Rep resigned without completing the required time or paying it off..

BPO company filed a breech of contract through civil court, Rep did not appear thrice, case was escalated to criminal case..

In account to this, Rep has a criminal case which may have future employment issues..

So my take on it... Really depends on the following:

- Value of the Bond (What was the exchange?)
- Clause of the bond
- Is it fair?
- Value of the excahnge to the company

If the bond seems unfair then the labor arbiter or even the company itself will not pursue

elo everyone! need help lang po regarding sa situation ko.. sana may makasagot sa mga questions ko...

I tried to pass a resignation letter na 2weeks notification lang. tinanong ko pa yung TL ko kung OK lang ba yun since ang nakalagay nga sa handbook ay 30 days dapat. sbi nya paguusapan daw ng boss nya yun and we’ll see what will happen. then after 1 week, akala ko naman approved na kasi wala malapit na yung effective date ng resignation ko. then I found out lang na di pala approved dahil dapat daw 30 days nga. he asked me kung gusto ko talagang magresign eh magpasa ako mg medical certificate. ang problem kasi wala akong nakuhang medical certificate kasi ayaw naman akong bigyan ng mga doctors since I am not sick daw. kaya nagAWOL na lang ako sa call center na to pero natapos ko naman yung 4 months na minimum stay so I don’t have to pay any bond.. and last week I received a RTWO from them.. and then akala ko after ng letter na yun eh NOT na ang matatanggap ko.. pero I just received a letter yesterday na dapat daw magreport ako sa kanila for an administrative hearing/conference regarding sa unauthorized absences ko.. pero siyempre *** naman na akong balak magpakita sa kanila kasi sesermonan lang naman ako. I thought lang kasi na terminated na ako after not reporting dun sa allotted time na binigay nila sa RTWO.

nagAWOL lang naman ako kasi very stressful talaga yung job and nagsasawa na talaga ako sa calls. and also I have a better offer sa ibang company pero different field. pero don’t get me wrong, tumaas ang respect ko sa mga agents dahil sa work experience na to. akala ko din kasi madali *** maging isang call center agent, pero napasubo ako kaya naman naisip ko na magresign nlng sa work.


and here are my questions...

1. im scared lang na baka kasuhan nila ako.. pero natapos ko naman yung 4 months contract or minimum stay so wala akong bond na babayaran.. yun nga lang hindi ako nakapagrender ng 30days na notice for resignation.. can the company sue me for that?

2. I have read sa mga ibang posts dito na yung mga agents na nagAWOL na pinagbabayad ng company ng bond ay nahihirapan kumuha ng NBI clearance kasi may nakalagay daw sa clearance na may utang pa sila sa company.. will it be the same in my case? I mean mailalagay din ba sa NBI clearance na nagAWOL ako?

3. I also read this post sa isang site:

“if you don't care about getting your backpay, employment certificate and such you can always go on AWOL to skip the bond...just make sure that the company you are transferring to is not near or not a member of the same org like CCAP.”

-so is it OK lang talaga in my case to just ignore the letters the call center is sending me?

All you need to do is to leave the company without submitting any formal notification like resignation letter. It is actually one way of terminating your employer-employee relationship. In this way, you'll be considered AWOL, enough basis for the employer to terminate or discontinue your employment. Regarding bond, No BPO company would waste any money to pursue any litigation which would incur additional expenses for the comany, and you may also have significant ground as stipulated and as laborer-protection under labor code of the PHils. with regards to the BOND being practised of some BPOs. :bop:

They cannot sue you, you formal resignation letter is sufficient enough that you've wanted to discontinue your employment with them.

I dont think so, if that's the case, have your concern be consulted to NLRC National Labor Relations. DOLE

regarding po dun sa first question, actually hindi approved yung resignation letter ko.. yun yung sabi po sa akin ng TL ko.. kaya wala din akong nareceive na acceptance letter from his boss.. so matatawag pa po din na official resignation yun kahit wala akong copy ng any letter? and i do believe hindi yun naforward ng TL ko sa HR..

Have it signed by your supervisor.
If He/She did not accept it, it's ok. all important is you informed them of your intention to discontinue your employment on the speific date you have written on your RESIGNATION LETTER.
the employer cannot force its employee to continuously working if the employee wants to discontinue his/her employment with them.

File a resignation and hopefully they'd understand the situation and just waive the bond for you..hopefully ha..kasi there are ccs talaga na nagpapabayad ng bond kahit nag-resign ka na. for instance, i have this friend who used to work for etel. lagi-siya inaatake ng high blood and naki-clinic pa so she was advised by her doctor to stop working in a stressful environment. she resigned and gave the medcert. they accepted the resignation but wala na siya nakuha backpay coz bayad na daw niya 'yun sa bond...:bop: (teka, ngayon ko lang naisip, ang alam ko bawal 'yun ah..) anyway, try mo i-check kung talagang naghahabol sila ng bond. magtanong-tanong ka kung may mga employees na sa cc mo na nag-resign pero pinagbayad ng bond..

IBA PA RIN KASI KUNG NAGPAALAM KA NG MAAYOS..NAG-RESIGN, that is...that's the PROFESSIONAL and PROPER way kasi *okay*..and at least hindi ka maba-blacklist sa cc na 'yun...

now, kung nagpapabayad nga sila or ayaw payagan ang resignation mo, then no choice but to go on AWOL...what's important is you informed them through your letter of your intention to discontinue employment with them but since di nila tinanggap yun, they left you with no choice but to go on AWOL...don't worry, HINDI NA MAGHAHABOL (sa bond) yun coz it would just be a waste of time, money and effort on their part. most likely (should you decide to go on AWOL) , you'd receive an RTWO from them and then a letter of termination pero wag ka matakot sa letters na 'yun. sort or protocol or formality na lang yun... :D after that, wala ka na maririnig sa kanila...yun nga lang most likely hindi ka na din makakapag-apply ulit sa cc na 'yun...

Ano ba process sa application/paglipat sa ibang call center habang currently employed ka pa sa isang call center?

Humihingi ba sila certification/ proof of employment or tinatawagan yung current and/or previous employers mo?

For example naka 1-2 months ka pa lang pero hindi ka satisfied sa work mo etc, kung ilalagay mo yun sa resume, hindi ba negative yun na ilang weeks ka pa lang and naghahanap ka na ng iba?

And what if yung current call center mo may bond and balak mo mag AWOL or something? Habang nag aapply ka sasabihin mo ba na nag AWOL or balak mo mag AWOL?

Kasi kung yung current call center mo yung 1st experience mo, kung hindi mo naman ilalagay na may experience ka then baka mababa ang offer.

Hindi kasi realistic na mag resign sa work kung wala ka pa naka line-up...

awol. kaso angot ng record mo n'yan. tsaka wag mo na lagay sa employment history mo yang current job mo na gusto mo ng iwanan. kaso kung bigla kayo mag-kita ng employer mo or sinoman from your company in the future which is a .01% chance lang naman kung talagang malas ka edi yari ka na. pero yun pinka-ok na magagawa mo.

di totoo ang bond. vxi may bond.. citigroup may bond.. etel may bond nag resign ako ng maayos sa lahat ng kumpanya na yan nakakuha pa ako ng backpay. bond is illegal. kaya di nila pwede ipursue kasi nasa labor code ng pilipinas na bawal ang bond.
