I just resigned recenty from a university where I used to work for 2 years.I was having my clearance & went to our Human Resource Department.Surprisingly, the person in charge told me that I was not completely registered to BIR, something like saying I am not a duly recognized member of the said institution. I was wondering, what happened to the tax deductions that I had.Was it not remitted to BIR?I mean like I feel like I deserve a refund because it only means that my deductions were nowhere to go..:grrr:What should I do?What is form 2316?thanks

First of all, BIR does not have "members". I think what the HR person is trying to say is that your taxpayer record with the BIR may not be complete. You do have a TIN, don't you?
Now, if you say you have been working for two years, that means you have at least one complete tax year on record. The employer should have deducted taxes from your pay, remitted the same to the BIR, and issued you a Form 2316 (Certificate of Compensation Payment/Tax Withheld). That is your evidence that your employer remitted taxes to the BIR on your behalf. Did you not get one?

yung ate ko naman meron siyang TIN may ID pa nga sya
mga 3years siyang work dito sa pinas then she work abroad
when time na bibili siya ng bahay at yung dating TIN niya
ang binigay niya sabi wala na daw yun.
kaya kumuha ng bagong number.
anong problem sa ganitong situation?
meron po bang nakakaalam

Problema lang yan kapag hahabulin siya ng BIR at pinaghihinalaan siyang hindi nagbayad ng buwis noong panahon ng dating TIN niya. Para patunayang nagbayad siya, kailangan niyang ipakita ng mga 2316 niya o ang ITR na angkop sa mga taong iyon.

I am sorry, I am really not the type of person na maalam sa mga BIR,SSS,GSIS,etc..kaya feeling ko meron itong membership lahat.What if wala sila maipresent sir?

Section 236 of the Tax Code provides that Only one Taxpayer Identificatin Number (TIN) shall be assigned to a taxpayer. Any person who shall secure more than one Taxpayer Identification Number shall be criminally liable under the provision of Section 275 on 'Violation of Other Provisions of this Code or Regulations in General'
Section 275 of the Tax Code provides that Any person who violates any provision of this Code or any rule or regulation promulgated by the Department of Finance, for which no specific penalty is provided by law, shall, upon conviction for each act or omission, be punished by a fine or not more than One thousand pesos (P1,000) or suffer imprisonment of not more than six (6) months, or both.

Importante kasi ito dahil dito malalaman kung may justification yung rational ng HR nyo na hindi ka mabigyan ng tax refund dahil hindi complete yung registration mo sa BIR. Kung mayroon kang TIN, ibig lang sabihin na kumpleto ang registration mo sa BIR dahil hindi ka magkakaroon ng TIN kung kulang ang registration mo sa BIR.
Humingi ka sa kanila ng BIR Form No. 2316 o Certificate of Compensation Payment / Tax Withheld. Dito mo makikita kung may tax refund ka (Check Item No. 48 - Tax Due at Item No. 49 - Amount of Taxes Withheld. Kung mas malaki yung Item No. 49, may Tax Refund ka). Kung makita mo sa 2316 na may Tax Refund ka, i-demand mo ito sa kanila, regardless sa dahilan nila sa registration status mo, as long na nagkaltas sila at nag-remit sa BIR, yung kasobrahan sa iyong kaltas ay dapat ibalika sa iyo. Kung hindi sila makikinig sa paliwanag mo, lumapit ka sa BIR na nakakasakop sa dati mong employer at ipakita mo ang iyong 2316. Dapat ang matatanggap mong 2316 ay may pirma ng kanilang Authorized Representative. Kung ayaw ka namang bigyan ng 2316, i-reklamo mo rin sa BIR, bibisitahin nila yan.

thank you very much..i have my TIN number pero sabi ng HRD parang d daw nakareflect sa BIR na employed ako sa kanila kaya pumasok agad sa isip ko san napunta yung mga kinaltas?supposedly kc mag uupdate ako from single to head of the family..Ano **** sir yung form 2305?thanks

Filing date:
File this form with the RDO where the taxpayer is registered, within ten (10) days after such change or event. (This form is given to the main employer, copy furnished the secondary employer).
Ang dami pong impormasyon sa website ng BIR. Kung may oras ka, dumalaw ka minsan at marami kang mapupulot na kaalaman.

ok thanks a lot for the information.They gave me form 2305.I asked for form 2316 but seems like ayaw ako bigyan..
