Mga peeps bago lang po ako and I just need help on this. Legal po ba na WAG kayong bayaran ng kumpanya ng night differential kung hindi naman naka indicate sa contract mo?
According to the labor code:
Art. 86. Night shift differential. Every employee shall be paid a night shift differential of not less than ten percent (10%) of his regular wage for each hour of work performed between ten o’clock in the evening and six o’clock in the morning.

I reviewed the contract and it was not specified that I will not get any night differential. Sino po ba pwede kong lapitan? Salamat po.

sa apat na pinaskuan kong call center, pati dun yung medical transcriptionist work ko, lahat nagbigay ng night differential basta pasok dun sa 10-6 yung hrs. mo.
itanung mo sa hr mo. baka di pa yan ang final contract mo.

Na-confirm ko na sa mga kasama ko. Final na yung contract, wala talagang night differential.

bobo ang mga managers kaya huwag ka sa kanila magtanung.

call center po ba yan, alam ko lahat ng call centers sumusonod sa night diff., sa aangas ba naman ng mga agents, susunod talaga mga yan, hehe.
pero walang biro, dapat sumunod sila. kung wala talaga, nasa sayo na yan. either umalis ka kung pakiramdam mo lugi ka o pagtyagaan mo muna ng 3-6 months as experience na lang, tapos lumipat ka na lang sa mas stable na company.
pero ako di naman ako nakaranas na full 8 hrs. pasok sa night diff. shift. kadalasan ang schedule naman na binibigay mga 3-4 na oras lang yung pasok sa night diff.

Salamat po sa reply nyong lahat. Ayoko naman pong umalis agad kasi parang masama tingnan sa resume. Gusto ko lang malaman kung meron akong pwedeng gawin. Try ko po yung advice ni taxiguy. Salamat po uli.

naku anung call center ba yan? paki-PM naman saken para at least alam ko rin... masabihan ang mga kakilala nating gustong mag-apply sa call centers... tsk! tsk! tsk!

explicitly indicated ba sa contract nyo na no night differential will be payed kung pumasok kayo within the hours na covered ng night differential? double check nyo baka naman may na-miss lang kayong statement. kung talagang nakalagay na di kayo babayaran kahit covered hours dapat, reklamo nyo. Nasa batas yan na dapat meron...

Baliktad, walang nakalagay sa contract about night differential so I thought the usual na meron. Pero na-confirm ko na wala but the labor code shows that we should have at least 10%.

Punta kayo sa DOLE file kayo complaint, para matulungan nyo na rin ang kapwa nyo Pilipino na bukas makalawa ay mag apply sa kumpanya na yan! O baka naman meron...Bobo lang siguro yung nakausap mo dyan sa kumpanya na yan. Marami talaga bobo ngayon!

I'm not sure pero unless it states on the contract that you wont receive the night diff....automatic yan na 10%....sa agents kasi samin its specified na 20% ang night diff because its higher than the amount mandated by law....sa TL naman and other officers its specified na they wont be receiving night diff.... so if no details are stated about the night diff malamang 10% yan....just to be safe anatayin mo sweldo and check your payslip ;) mahirap magreklamo at mapahiya....

Pero siguro, mas maganda kung naitanong niyo yung bagay na yan during the day that you were given the job offer. Siguro naman, at least, an officer was there to accomodate your questions about your contract. Dapat you asked them about it before you signed. Mahirap na, sumuweldo ka, tapos wala palang ND na kasama, tapos saka ka lang magrereklamo diba?

bakit sumbong agad kung hindi mo pa naitatanong sa HR nila? ask your HRD, then ask for another copy that states na may night diff ka

mag request din po kayo ng copy ng computation sa payroll department ninyo. baka kasi nde lang nga naka indicate.anyway,pwede naman habulin yan or i-retro kung sakaling nakalimutan nilang isama yung night diff.maraming palpak na payroll personel nagre-rely lang sila dun sa software na ginagamit nila.madalas may mga bugs yun.

There are certain factors and conditions to consider, including, among others, your position and responsibility in the company.
As a general rule, if the contract is silent, it is usually ruled in favor of labor (the employee). So unless it is explicitly said that you are exempted from the ND, then you should be receiving it.
However - there may be contracts that specify that your salary is "all-in" inclusive of such other payments.
BTW, how were you able to confirm na wala ngang ND? Who did you talk to, and what did they say?

As you have not (yet) mentioned the type of job you handle, Article 86 would have to be qualified by Article 82 first.
Art. 82. Coverage. The provisions of this Title shall apply to employees in all establishments and undertakings whether for profit or not, but not to government employees, managerial employees, field personnel, members of the family of the employer who are dependent on him for support, domestic helpers, persons in the personal service of another, and workers who are paid by results as determined by the Secretary of Labor in appropriate regulations.
As used herein, "managerial employees" refer to those whose primary duty consists of the management of the establishment in which they are employed or of a department or subdivision thereof, and to other officers or members of the managerial staff.
"Field personnel" shall refer to non-agricultural employees who regularly perform their duties away from the principal place of business or branch office of the employer and whose actual hours of work in the field cannot be determined with reasonable certainty.

The thing is you signed, and believe it or not night diff is just a meager amount when added to your salary(unless you get a full grave yard shift ND is from 10pm-6am), have you already checked your pay slip?

Salamat po sa mga reply nyo lalo na yung kay Council malaking tulong po talaga. I'll be reviewing my contract and the labor code again and I'll be more carefull this time. I didn't see Art 82. Salamat po ulit as lahat.
