View Full Version : Chewed Glass Shard in Food Bought from Company's Concessionaire--Should I Sue?

I hope anybody would be able to help me with this--here's what happened...

During my break at work, I bought food (ulam & rice in disposable plastic box) from one of my company's concessionaire--the food stall is not branded but the HR people say they have stalls in other companies. While I was chewing away, I bit on something hard and spit out a triangular shaped piece of glass shard (about 0.5 cm).
I immediately reported this to the seller who just said sorry--and that it might have been accidentally incorporated in the food. As she said this, she kept on selling the SAME food on the table.

As the owner of the stall wasn't there I wasn't able to complain to them so I reported the seller to the HR. I also went to the company doctor since the roof of my mouth was profusely bleeding by the time I got to the HR. The doctor said that I should observe my poop to check if it was black or muddy in case I digested small glass shards--and if it was, to go immediately to the hospital (we have medical insurance through the company).

I have a an inch cut on the roof of my mouth, almost close to having a panic attack over the contents of my stomach (Xrays cannot detect glass), and the seller got off only with a rebuke and an incident report.

What should I do??? I would like to sue the owner but I'm thinking twice about the lawyer's fees and the time it would take to process this. (My uncle was a victim of a hit&run last year, had to have brain surgery because blood was entering his brain, paid P500,000 for the surgery and still the case has not moved.)

I still have the glass shard.

find a good lawyer who has has the heart to get your case settled and not just in for the money. Sadly there are a lot on the latter.

Anyway, no need to think about it. If it happened to me, I would have sued at once and took them to court.
