To All Yuppies: Sino sa inyo nakatanggap na ng 13th Month Pay?
Kse I have noticed that many people nowadays are shopping for their christmas list for gifts.(Especially Yesterday Nov 30)

Hi floreno! Our receptionist/secretary told me that according to the law, the 13th month pay should be given not earlier than Nov. 15, and not later than Nov. 30 (or Dec. 1? Not sure.). If that's true, then everyone should have received their 13th month pays already. :)

we got our 13th month pay last november. Sa dec, bonus naman. i think the 13th month pay is mandatory. Anyway,
goodluck... medyo hirap din buhay ngayon.

Hi Caramba!! But what I understand with the Labor Code
in the Phil. Employers SHOULD provide the 13TH Month
pay on or Before Dec 24, Otherwise, DOLE would
put legal sanctions to the Employers who would disobey it.
Sad to say, Kami wala pa at nangangamba kami na baka
gawing installment yung 13TH month pay just like last year
(last payment was given January na.....my gosh )

bawal un as the labor code does not provide for installment basis... dec 24 nga is last day ng bigayan... quite useless if u ask me...

grabe... i know what u mean. i have some friends in other companies who have staggered 13th month pays; e.g. their companies tell them that mid-year bonuses were in fact 13th month installments. pero when those bonuses were given (mid year) there was no mention of this bonus as the 13th month installment. in fact, it was "half-said" na bonus lang siya, plain and simple, not a 13th month...
daya noh? oh well.. :( as the flak cannon unit in red alert 2 says, "at least i have job". hehe :D

Ours was given on an installment basis. The half of our 13th month was given last May and the remaining was given last November 29. The 14th month ( sana meron) will be given this December 15.
Saikee, it is against Labor law to give your 13th month after December 24th. You can file a case against your company.
Well, nagalaw ko ka rin ang 13th month ko. I start buying gifts last long weekend.
For those who will buy gifts in crowded places such as Baclaran and Divisoria, ingat lang. Hirap ng buhay ngayon.

Please clarify the 'standard' computation of 13TH Month pay...
is it:
(Basic Pay * Months Stayed in office) / 12
Is this the basic rule as per Labor Code law is Concerned:
I am asking this because in our office, they might deduct
our abcenses during the year(2001)..so giving the computation:
(Basic Pay * Months Stayed in office) / 12 - (Equivalent Abcences in pesos)

It's interesting you guys get 1 month's bonus paycheck. That would be sweet if we had such a thing here. We just get our paycheck for our salary or hours worked depending on the payscale but no christmas bonus.

Sa amin ang ginamit ay yung unang formula mo. I computed my own 13th month pay using that formula and I got the amount stated in my pay slip. I had about 4 absences this year so I guess it's safe to say that my absences were not deducted. However, I suggest you ask lupuS regarding this one.

The law allows employers to deduct absences without pay from 13th month, which is what we do. Some companies decide it's not worth the trouble to do this.

floreno - i remember reading a report that dole said a certain amount of companies do not comply with wage policies of the philippines. i guess ur company is one of them... alis ka na dun. ur employers r cheating u guys. sad, but true.
